How can a spouse be added to a mortgage? Just in case anything should happen to one or the other. So they are both protected. Currently only he is on the mortgage. They just got re-married and want to both be on the deed.My mother in law just married a man that just bought a home a few years ago, he wants to add her. How can he?
Being on the mortgage and being on the deed are two entirely different things.
To be on the mortgage, the house would have to be refinanced in both names. Depending on the amount to be refinanced, it could be thousands of dollars in closing costs.
A quit claim deed is not a way to add a name to the deed. Contact a title company in your area and ask about a general warranty deed.My mother in law just married a man that just bought a home a few years ago, he wants to add her. How can he?
Forget about the person who mentioned a quit-claim deed. A quit claim deed is just what it says - someone is giving up, or quitting, any and all claims they have to a property. In this situation, no one is giving up any claim to a property, so a quit claim deed in inappropriate.
I wish people who don't know the correct answer would just not answer a question instead of giving incorrect information.
Your mother-in-law's name needs to be added to the warranty deed on the property. Your mother-in-law does not want to be on the mortgage unless she is on the deed to the property. After she's on the deed, it's just a matter of contacting the mortgage company to let them know she should be added to the mortgage and they will fill out all the necessary paper work.
If your mother or her spouse does not know how to properly fill our and file a warranty deed, the mortgage company may be able to do it for them, as someone else said, for a fee, or a title company or an escrow company can do it, or any attorney can do it. The fee should be nominal, because it's a relatively simple procedure.
She doesn't need to be added to the mortgagee she needs to be added to the deed to the home. He can gift her 50% of the home as his spouse. Also it can transfer in the event of a death to who ever is still living. The mortgage can stay as is.
They need to contact the mortgage company and they will set everything up, they may charge a fee to do this because they will need to do a title search again.
A quit claim deed needs to be filed. Who owes money to a mortgage company has nothing to do with who owns the property.
Two separate items.
